This Privacy Policy ("Policy") outlines how AXAONE TECHNOLOGIES PRIVATE LIMITED ("Company", "we", "us", or "our"), operating under the brand name HealthSy, collects, uses, stores, discloses, and safeguards the personal information of all users, including Customers, Members, Patients, Third-Parties or Partners, and any other individuals "You", “Your”, "User" shall mean and refer to natural or legal person who uses, registers, our service, through thewebsite or our mobile application  "HealthSy" for User App ("App"/"HealthSy App") or the website located at https://healthsy.app(“Site” or “M-Site”), collectively called as Platform.

 

1.GENERAL

 

(a) This electronic document is governed by “The Information Technology Act, 2000", and "The Indian Contract Act,1872" and applicable rules. It is computer-generated and does not require any physical or digital signatures. It is published under "Rule 3(1)" of the "IT Act (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2021" and all other rules, and guidelines framed thereunder including IT (Reasonable Security Practices and Sensitive Personal Data or Information) Rules, 2011, requiring disclosure of terms, privacy policies, and platform access conditions which is governed by GDPR and Digital Personal Protection Data Act, 2023,Telemedicine Practice Guidelines, 2020 -Ministry of Health and Family Welfare (MoHFW) in collaboration with the National Medical Commission (NMC) along with all other relevant Indian laws, rules, and guidelines.

(b)This Privacy Policy applies to all the "User/Member/Customer/Patients" including third-party doctor/pharmacies/home healthcare service providers. Third parties shall also comply with their respective policies.

(c) The terms used in this Privacy Policy have the same meanings as in our Terms and Conditions, which is accessible at the “HealthSy” websiteandour mobile applicationunless otherwise defined in this Privacy Policy.

(d) This Privacy Policy is an integral part of our Terms and Conditions. We recommend that you read this Privacy Policy along with the Terms and Conditions. By using our platform, you agree to be bound by all company's policies (including but not limited to the terms and conditions available on the platform) as amended from time to time.

(e) If you disagree with any part of these Terms or this Privacy Policy, we advise you to refrain from using the Platform. We encourage you to share your concerns or feedback with us through the official communication channels provided.

(f) By accessing or using the App and/or Website, you acknowledge that you have read, understood, and agreed to the terms of this Privacy Policy, and you consent to the collection, processing, and disclosure of your information as described herein. The information on the webpage is like that on the application. Since the webpage is a non-e-commerce platform, it is intended solely for informational purposes and thus only your interest in facilitating our services may be submitted.

 

2.ABOUT HEALTHSY

 

"HealthSy", the brand name of AXAONE TECHNOLOGIES PRIVATE LIMITED is amobile application (available on Android and iOS platforms) and an online platform operated by the Company. The Platform acts as a marketplace and technology facilitator offering services including, but not limited to:

·         Order medicines (and healthcare products),

·         Online doctor consultations,

·         In-clinic appointment bookings,

·         Home healthcare bookings,

·         InstaDoc consultations.

The Company operates in collaboration with third-party service providers such as offline retail pharmacies (including partnered pharmacies), doctors, and home healthcare service providers (“Partners”) across India, who render services directly to the "Users/Customers/Patients/Members".

The Platform serves as a technology bridge connecting "Patients/Customers/Members" or their authorized representatives or affiliates with the third-party service providers (including partnered 

pharmacies) to facilitate healthcare access seamlessly and conveniently.

 

3. INFORMATION WE COLLECT

 

The information collected from "You" by the "Platform" may constitute 'personal information' or 'sensitive personal data or Information' under Rule 3 of Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 (SPI rules). As per the Right to Information Act, 2005, information that is freely available in the public domain is not considered personal or sensitive personal data.

·      Consultation history includes doctors who has given prescription, treatment plans and medication, diagnostic results, other health-related information of You or any of Your family members (for the hereditary diseases/ disorders) and any other information inferred therefrom medical records, prescription, chats, audio and video calls between doctor and patients and such other similar details

 

·        Appointment History, Order Details including Delivery details, Home Healthcare Service Booking History

 

·        Sexual orientation

 

·        Passwords or OTP

 

·     Internet activity, such as your Internet Protocol (“IP”) address, browsing history, your search history and information on your interaction with the HealthSy's services and our advertisements

 

·        Device information

 

·        Geolocation data, e.g., your physical location or movements (See “Cookies and Web Beacons” below)

 

·        If you are accessing HealthSy websites or apps on your mobile device, you may also choose to provide us with location data. To protect your privacy, you should not provide HealthSy with any information that is not specifically requested.

 

If you are a third - party professionals on-boarded with any one of the "HealthSynergy" Programmes, we may also collect:

 

·     Third - Party Doctors - educational details, registration details, clinic details, photos, bank account details including other details mentioned in respective programme's terms & conditions and privacy policy.

 

·        Third - Party Retail Pharmacies - All pharmacy related licenses, certificates, registration details, bank account details, photos, delivery agent details, PoC details, Pharmacists details including other details mentioned in respective programme's terms & conditions and privacy policy.

 

·        Third - Party Home Healthcare Service Providers - educational details, registration details, self-identification proofs, clinic details, photos, bank account details including other details mentioned in respective programme's terms & conditions and privacy policy.

 

·        Publicly - available information related to your practice, such as license information, disciplinary history, prior litigation and regulatory proceedings, and other due diligence related information.

 

·        Any detail relating to the above Personal Information categories as provided to us for providing service; and any of the information received under the above Personal Information categories by us for processing, storing, under lawful contract, or otherwise.

 

If you are a user who is seeking employment opportunities at HealthSy, we may also collect information included on a resume or curriculum vitae, education, and work history (such as work experience, education and languages spoken, and such other similar detail.)

 

Above mentioned data (Personal data and Sensitive Personal Data or information collectively, referred to as “Sensitive Personal Data or Information”) are all protected and must be processed under lawful contracts. As per the Right to Information Act, 2005, information that is freely available in the public domain is not considered personal or sensitive personal data.

 

When "You" visit the website or approach our platform, you voluntarily provide us with your personal information, and by clicking on continue you affirm and provide your consent by agreeing to the Company's privacy policy and all other policies.

 

By using our services and providing your sensitive personal data, you are implicitly consenting to share your information to ensure a seamless experience with our service.

 

We may also collect any other personal information submitted by you through surveys, questionnaires, E-forms, social media handles, google listings, similar kind of platform or channels.

 

For mobile applications, "We" may also collect your data or information while you visit our platform that our browser sends to us through cookies or our own tracker which is not a third-party application. Additionally, if you show interest in a third-party medical practitioner or home healthcare service provider, we may store this information for future reference.

 

You are solely responsible for the accuracy of the information you share, and the platform acts solely as an aggregator connecting you with the third - parties. We do not assume responsibility for any untoward activities, claim for damages or any other liability as our role is limited to facilitating services between users and third - parties.

 

We also use any third-party tools or software to collect the aforementioned data from the User/Patients. We may also collect your other data via cookies, google analytics or any other similar technologies.

(a) How We Use Cookies on Our Website?

 

When you visit our website, cookies may be generated. These cookies allow us to identify if you have visited our site previously, helping us track the number of unique users and their visit frequency. The data collected is used solely for statistical purposes and to enhance the operation of the HealthSy website(s). It may collect information such as your device information, whether you are using a Mac or a PC, or an iPhone or an Android phone, Internet Protocol Address (IP Address), the address of the webpages you visited, browser type and settings, the date and time of your access ,geo location and other data.

 

Whenever users visit our website, we use web analytics software i.e GA4 provided by Google, Inc. (“Google”) to generate anonymous analytics cookies. By using our website, you agree to the processing of your data by Google in the manner (Google Analytics 4 Policies shall also apply) and for the purposes described above.

(a) How We Use Web Beacon?

 

We use tools that gather information to optimize ad campaigns, create targeted audience segments, and retarget users based on their ‘behaviour’. The data collected typically includes details about how users interact with ads, which helps in refining advertising strategies and improving overall campaign performance on various social media platforms.

 

We use Meta Pixel (Meta Pixel Policies shall also apply) which collects data specifically to optimize Facebook ad campaigns, build targeted audiences, and retarget users. Its data collection is centred around interactions related to ad performance and user engagement on Facebook and Instagram platforms.

 

3.3. Data collected by Third-Party (for User-Patients)

 

We use Razorpay, a third-party payment gateway, for processing payments. AXAONE does not collect, store, or process any payment-related data, including payment card numbers, expiration dates, UPIs and other similar data. Our role is limited to receiving confirmation and transaction ID from Razorpay after a successful transaction. For information on how Razorpay handles your payment data, please refer to their privacy policy.

 

3.4.Where We Store Data

 

Data collected under this Privacy Notice is hosted on servers located in India.

 

3.5. Use, Share, and Disclosure of Collected Information

 

The information collected is used solely for providing and managing the services you request. We do not sell any collected information, however, may share your information with trusted third parties necessary to provide those services, such as third-party doctors, third-party pharmacies and third-party home healthcare service providers related to your services. We do not disclose your information to unauthorized parties or use it for purposes beyond what is required to deliver the services you avail. Your privacy and the protection of your information are important to us, and we are committed to ensuring that your data is handled responsibly and securely.

 

3.5.1. HealthSy Services:

 

 The use of additional information or data collected from users in relation to the services they avail of is as follows:

 

·        Online Doctor Consultations

 

Chat, Audio and Video call features are specifically utilized for online doctor consultations. To ensure a smooth experience, we may request access to your camera and microphone. Your privacy is a top priority for us. Any data including affected areas collected during audio and video calls, as well as chat interactions, is used exclusively for the purpose of the consultation and is handled with the utmost care and security.

 

Both users and third parties are prohibited from misusing any data or information shared during these interactions. Furthermore, this data cannot be used for commercial purposes by any party, including the company. We are committed to safeguarding your information and maintaining the confidentiality of your consultations.

 

·        In-Clinic Appointment

 

During in-clinic appointments, you agree to allow third-party doctors or clinics to scan the unique QR code provided for your upcoming consultation. This scan is a part of the check-in process and is used solely to confirm that your appointment has started. In case of pay at clinic, respective clinic's payment policy may apply. AXAONE does not collect, store, or process any payment-related data, including payment card numbers, expiration dates, UPIs, other similar data. Our role is limited to receiving confirmation after a successful consultation and payment. Any kind of fee or other discrepancies report to HealthSy.

 

Role Based Profiles: A doctor can set up different profiles for their staff/PoC with different levels of information access. This ensures that only the doctor has access to the patient files while the staff access is restricted to the clinic operations rather than the patient information.

 

·        Home Healthcare Service

 

a.   Access to Residence: You consent to grant access to your residence for the purpose of providing necessary healthcare services as prescribed by the medical practitioner.

 

b.   Consent for Treatment: You provide consent for any treatment plans, procedures, or therapies recommended by the medical practitioner during the session. This includes agreeing to follow the prescribed treatment and any associated procedures.

 

c.    Emergency Procedures: In case of emergencies, you agree to seek immediate medical assistance from a licensed medical practitioner. The healthcare service provider is not liable for any emergency situations that may arise outside the scope of their service.

 

·        Order Medicine and Healthcare Products

 

      The information collected is used to:

 

a.  Order Details to accurately dispense medications according to your prescriptions and deliver to your door-step.

 

b.     Prescription to pharmacists who will use the information, such as your medical history along with prescriptions, to offer guidance on the proper use of medications. This includes informing you of potential side effects, interactions with other medications or conditions, and any necessary precautions to ensure safe and effective use of your medications.

 

c.     To assist in the customization of orders to meet your specific healthcare needs.

 

d.    Manage billing processes, payement processes and address questions or concerns related to your order.

 

e.  Access to Residence for the delivery agents: You consent to grant access to your residence and your order details ( up to delivery relevance) to the delivery agents for the purpose of providing order deliveries.

 

f.    Both users and third parties/partners are prohibited from misusing any data or information shared during these interactions. Furthermore, this data cannot be used for commercial purposes by any party, including the company. We are committed to safeguarding your information and maintaining the confidentiality of your consultations.

 

·        InstaDoc Consultations

 

Chat, Audio and Video call features are specifically utilized for InstaDoc consultations exclusively with  general physicians. To ensure a smooth experience, we may request access to your camera and microphone. Your privacy is a top priority for us. Any data collected during audio and video calls, as well as chat interactions, is used exclusively for the purpose of the consultation and is handled with the utmost care and security.

 

Both users and third parties are prohibited from misusing any data or information shared during these interactions. Furthermore, this data cannot be used for commercial purposes by any party, including the company. We are committed to safeguarding your information and maintaining the confidentiality of your consultations.

 

3.5.2. HealthSynergy Programmes:

 

The use of any information or additional data collected from the third - parties or partners on-boarded to their "HealthSynergy" Programmes are as follows:

 

Verification and Drafting of LoU, Creation, and Activation of your profile in the HealthSy platform to start your services to the HealthSy users, we shall use/display the collected information in your profile on our platform to increase your visibility in the healthcare industry, communications other similar data which are mentioned in the respective programme's T&C's and Privacy Policies.

 

The information shared by you and collected by us is verified for more transparency and to avoid discrepancies. The information gathered shall be disclosed, published and listed on our platform with the end users in our HealthSy platform for users. The platform encourages you to check any inaccuracies from time to time and inform us so that we can make the changes accordingly. The platform will not bear any liability for any incorrect information appearing on the platform upon failing of sharing such information by the third - parties/partners.

 

3.5.3. Careers:

 

The use of additional information or data collected from the individuals in relation to the employment opportunities are as follows:

 

When you apply for a job on our platform, we collect and store your information, including resumes and cover letters, for documentation and evaluation purposes. This data helps hiring managers assess your application and may be retained for future recruitment. We safeguard your information against unauthorized use and share it only as required by law.

 

3.5.4. Disclosure of Information:

 

(a) Change in Control or Sale:

 

The Company can also share user’s personal data as part of a sale, merger or change of control, or in preparation of any of these events. Any other entity that buys our Company or part of the business will have the right to continue the user’s data, but only in the manner set out in this Privacy Policy.

 

(b) Legal Disclosure:

 

It’s possible that the Company needs to disclose certain information about you when required by law, subpoena, or other legal process or if the Company has a good faith belief that disclosure is reasonably necessary to

Any individual or third-party/partner found misusing, unauthorizedly accessing, or using any data obtained through or from the HealthSy platform whether for personal gain, commercial exploitation, or any unlawful purpose shall be held solely and strictly liable for such breach.

 

Such conduct shall constitute a violation of applicable data protection laws, intellectual property rights, and contractual obligations, and may result in legal proceedings, including but not limited to claims for damages, injunctions, and penalties under prevailing laws.

The Company reserves the right to initiate appropriate legal action against such violators and to report such incidents to the relevant authorities without prior notice.

 

4. PRIVACY CHOICES

 

You may have certain rights and choices regarding our processing of your personal data. Depending on your jurisdiction, applicable law may entitle you to additional consumer rights, including the right (with certain limitations and exceptions) to:

 

·    Know the categories and/or specific pieces of personal information collected about you, including whether your personal information is sold or disclosed, and with whom your personal information was shared.

·         Access a copy of the personal information we retain about you.

·         Request deletion of your HealthSy account.

 

We reserve the right to verify your identity in connection with any requests regarding personal information to help ensure that we provide the information we maintain to the individuals to whom it pertains and allow only those individuals or their authorized representatives to exercise rights with respect to that information.

 

We will not restrict or deny your access to our HealthSy Services/programmes because of your choices and requests but we reserve the right to deny your request if we cannot verify your identity. Where we deny your request in whole or in part, we will endeavor to inform you of the denial.

 

You may exercise any of your rights in relation to your personal information by contacting us using the details provided under the "Notices/Grievance" section below.

 

5. DATA SECURITY

 

Encryption and secure protocols are used to prevent unauthorized access to sensitive health data. Our company has implemented reasonable measures to ensure the confidentiality, integrity, and security of all confidential information, as mandated by applicable Indian laws and regulations. In fact, HealthSy has also taken initiatives and established best practices, standards and initiatives in cyber security and privacy.

 

For our service Online Doctor Consultation and sub-platform InstaDoc, these are a few of our many security features that ensure security and privacy of the patient and doctor's data such that only the doctor or someone authorized by the doctor can access the data and no one else, not even HealthSy, can access this information.


a)    HIPAA Compliance: All your audio and video call data are functioning under HIPAA-compliant servers ensuring industry standard consent architecture and privacy policies.

 

b)    Encryption: All your data is encrypted with 256-bit encryption. Data is encrypted during transit and rest ensuring that only the sender and the authorized receiver can access it.

 

c)     Two Factor: We have implemented 2-factor authentication to ensure we can doubly verify the identity of the person accessing the information and only give access to the doctor.

  

It is our practice to take steps to secure our services; however, the confidentiality of information transmitted over the Internet cannot be guaranteed. We urge you to exercise caution when transmitting personal information over the Internet, especially personal information or sensitive personal information related to your health. We cannot guarantee that unauthorized third parties will not gain access to your information; therefore, when submitting personal information to our websites or apps, you must weigh both the benefits and the risks. Our websites or apps may link to third-party websites that are not controlled by us or subject to our privacy policy. You should check the privacy policies of such third-party websites before submitting personal information.

 

6. CHILDREN/MINORS

 

This Website is not for Children. We do not knowingly collect or use any information from children (we define “children” as minors who are under the age of 18). We do not knowingly allow children to communicate with us or use any of our services without parental guidance. If you are a parent and become aware that your child has provided us with information, please contact us, we will work with you to address this issue.

 

7. THIRD-PARTY SITES

 

If you provide any personal information through a third-party platform, your interaction and your personal information will be collected by, and controlled by, the privacy policy of, that third-party platform. For example, when you share your personal or sensitive information related to job openings through third-party platforms (such as LinkedIn or Naukri), their respective privacy policies will apply. We recommend that you familiarize yourself with the privacy policies and practices of any such third parties, which are not governed by this privacy policy.

 

8.CHANGES IN THE INFORMATION PROVIDED

 

If the personal information or any other information we collect during your registration, changes or if you need to update, to correct inaccuracies, or amend any information, you can do so by contacting us. In case of third - parties the platform encourages them to periodically review the accuracy of their information and inform us of any inaccuracies for prompt correction. 9. DELETION OF YOUR ACCOUNT & RETENTION OF DATA

 

If you wish to no longer use our services, you may delete your account. Please note that account deletion is subject to our review and approval process. The process is given below:

 

·        Submitting an account deletion request through the app;

·        Contacting our support team; or

·        Simply sending an e-mail to support@healthsy.in. with the appropriate reason.

 

The company shall take one month to respond to such requests, with potential extensions of up to two months in complex cases.

 

Exception: If your account has any active orders, appointments, consultations, service bookings, or outstanding payments, the deletion process will be paused. Your request will be processed only after such activities are completed, delivered, or cleared.

 

The Company will review your cancellation, returns, and refunds based on the services you availed. The final decision rests with the company.

Upon such deletion, your account and associated data will be permanently removed, and you will lose access to:

 

·        Account credentials linked to your phone number

·        Your activities i.e., Appointment History, Consultation History, Order Details including Delivery details, Home Healthcare Service Booking History, InstaDoc Consultation History

·        Prescriptions

·        Payment Information

·        Access to HealthSy Credit- Cashback Earned, Offers, Coupons and others.

·        Any HealthSy Plus Membership (if any), No refunds will be processed for the remaining period of your membership.

·        HealthSy Advantage Subscription Plan (if any), which shall automatically be terminated.

 

This action is irreversible. However, we may retain the following details for legal, business and record-keeping purposes:

 

·        Contact Information

·        Profile Details 

·        Transactional Records and Service History

·        Communication Logs or Support Interaction

·        Any other details required to comply with legal obligations or respond to inquiries

 

We take reasonable and appropriate security measures to protect retained data against unauthorized access, alteration, disclosure, or destruction. Once the data is no longer legally or operationally necessary, it will be securely deleted. 

 

Additionally, the Company reserves the right to delete or deactivate user accounts without prior notice in the event of

 

·        Violation of our Terms of Service or Privacy Policy

·        Engagement in fraudulent activities

·        Breach of any applicable laws or regulations.

 

Such deletion may also result in the permanent removal of associated data mentioned in this clause, subject to legal obligations for data retention. 

 

If you wish to start using the HealthSy app again after your account deletion, you shall be required to create a new account as previous account data shall not be retrievable. 

 

10. WITHDRAWAL OF YOUR CONSENT

 

You have the right to withdraw your consent to the collection, use, processing, or sharing of your personal information, as governed by this Privacy Policy. To do so, you may send a written request to support@healthsy.in. with appropriate reasons. The company shall take one month to respond to such requests, with potential extensions of up to two months in complex cases.

 

Exception: If your account has any active orders, appointments, consultations, service bookings, or outstanding payments, the withdrawal process will be paused. Your request will be processed only after such activities are completed, delivered, or cleared.

 

 Please note that withdrawing consent may limit or completely restrict your ability to access or use our services. Upon receiving your withdrawal request, we will delete your respective data within a reasonable period, subject to any legal or regulatory retention obligations.

 

11. APP PERMISSIONS THAT WE CAPTURE

 

We ask for the following app permissions while onboarding, in order to optimize the experience for you:

 

Location:

 

It is recommended that you set your location sharing 'Allow While Using the App' as it helps us to show you location-specific data like availability of services. You can change this anytime.

 

Camera:

 

To allow you to take a photo of prescriptions & directly upload it to the app. To allow to do video consultations with regard to online doctor consultations.

 

Photos/Media/Files:

 

Media access permission is needed to store and retrieve your uploads such as prescription uploads, health-related images, documents or reports on your device.

 

SMS:

 

To support automatic OTP confirmation, so that you don't have to enter the authentication code manually.

 

Receive SMS:

 

This helps us to send you notification - related SMS.

Access Wi-Fi State:

 

This helps us to optimize your experience based on the Wifi’s strength and signals, especially for optimizing video consultations.

Bluetooth:

 

Bluetooth is used to redirect to Bluetooth headset during video or audio consultations.

 

12. AMENDMENT

 

We hold the sole right to modify this policy without prior permission from “You” or informing “You”. The relationship creates a duty on “You” to periodically check this policy and stay updated on its requirements. If “You” continue to use the platform, following such a change, this is deemed as consent by “You” to the so-amended policies. If you comply with this policy, we grant you a personal, non-exclusive, revocable, non-transferable, limited privilege to access and use the website and mobile application. If the User does not agree to the revised or modified policy, their sole remedy is to discontinue use of the Platform and its services.

 

13. SEVERABILITY

 

If any court or competent authority finds that any provision of this Privacy Notice (or part of any provision) is invalid, illegal or unenforceable, that provision or part-provision will, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of this Privacy Notice will not be affected.

 

14. WAIVER

 

No failure or delay by the Company in exercising any right, remedy, or provision under these terms & conditions shall operate as a waiver of such right or provision. Any waiver must be expressly stated in writing to be valid. A single or partial exercise of any right shall not prevent the further exercise of that or any other right.

15. NOTICES AND GRIEVANCES

15.1. Any legal notice, communication, or grievance intended to be addressed to the Company shall be sent either:

·        In writing, to the Company’s registered address; or

·        By email, to the designated Grievance Redressal Officer.

 

15.2. All such notices or grievances must be in English and shall be deemed to have been duly communicated along with:

 

1.     Full name and contact details of the complainant

2.     Nature and description of the grievance

3.     Relevant supporting documents or evidence (if any)

4.     The specific URL or content (if applicable) involved

5.     A declaration that the information provided is true and correct

15.4 Lodging a Grievance

 

Users may submit grievances or concerns regarding any content on the Platform, or any other matter relating to the use of the Platform, including but not limited to:

 

·   Violation of these Terms & Conditions or Privacy Policy

·   Offensive or harmful content

·   Unauthorized use of personal data

·   Intellectual property violations

 

15.5. Redressal Timeline

 

Upon receipt of a valid grievance, the Grievance Officer shall:

 

·    Acknowledge the grievance within 48 (fourty-eight) hours, and

·      Endeavour to resolve it within 30 (thirty) days from the date of its receipt.

In certain cases, resolution may take longer, in which case the complainant will be informed of the extended timeline.

 

15.6. Appeals

 

If the "User" is dissatisfied with the resolution provided by the Grievance Officer, the User may       escalate the matter to higher authorities within the Company or pursue the remedies available under       applicable laws.
